Comey, James Escape Charges After Prosecutor Ruled Invalid

Thanks in part to holdups on Trump U.S. attorney confirmations by Senator Chuck Grassley (R-IA), charges filed by Trump appointed U.S. attorney Linda Halligan against DNC operatives have been dismissed. U.S. District Judge Cameron McGowan Currie dismissed the charges against former FBI Director James Comey and current Fulton County Attorney General Leticia James.

The Judge ruled the Halligan was inappropriately appointed and thus has no authority to file charges before a U.S. court. Since the judge dismissed the charges, they can be brought again. Grassley held up the confirmation of Lindsey Halligan using a Senate traditional rule called the “blue slip,” which allows a home-state Senator to hold up any confirmations of their constituents for any reason.

Earlier in the day, U.S. District Judge Cameron McGowan Currie, a Bill Clinton appointee, ruled that Interim U.S. Attorney Lindsey Halligan was incorrectly appointed, and therefore, the indictments brought by her office against Comey and James were “defective.”

“All actions flowing from Ms. Halligan’s defective appointment … constitute unlawful exercises of executive power and must be set aside,” the judge wrote.

“Because there are multiple previously-scheduled matters that are expected to draw large numbers of people to the courthouse at the same time as the arraignment, and because it is necessary to ensure the security of the Court, the parties, and the public, it is hereby ordered that Defendant is summoned to appear for arraignment before this Court on Wednesday, October 8, 2025, at 10 am.,” the judge said.

Comey was originally set to be arraigned this Thursday morning after he was indicted by a grand jury in the Eastern District of Virginia last month.

His case was assigned to US District Judge Michael Nachmanoff, a Biden appointee.

Halligan’s surprise elevation to lead the pivotal prosecutorial office comes as top Trump allies sharpen their attacks on James, with White House press secretary Karoline Leavitt accusing her Monday of turning the justice system into a political weapon.

“Letitia James completely abused her oath of office,” Leavitt said Monday afternoon. “What was Letitia James’s campaign slogan? It was ‘prosecute Donald Trump.’ She was saying she was going to prosecute Donald Trump before she even knew if Donald Trump committed a crime — which, of course, we did not.”

Halligan formally took over the position as the lead prosecutor for the Commonwealth’s Eastern District shortly after Leavitt’s remarks to reporters, CNN reported, including a photo of Halligan reportedly arriving for her first day.

The Virginia prosecutor’s office had been under pressure from top administration officials for months to bring charges against James, who led the civil fraud case against Trump last year, resulting in a $454 million judgment against him. The financial component of that judgment has since been overturned, and the Democratic-led Empire State is appealing that ruling.

The scope of the federal government’s investigation into the 22-year-old college student has expanded beyond his roommate, a transgender video gamer who relatives say developed a hatred of conservatives and Christians in recent years. Those sentiments were shared by Robinson on online message boards, such as those popular among gamers who use the app Discord.

Patel told “Fox & Friends” that he believes others who listened to Robinson’s nefarious planning and did nothing may also be charged.

“There’s more than 20 individuals,” Patel revealed about the Discord chat where Robinson made ominous references to his discarded murder weapon and bullets engraved with chilling anti-Trump messages.

“People think we can just get into these group chats and immediately find out who was in them. We, the FBI, are the investigatory body supporting multiple prosecutions and ongoing investigations,” Patel explained.

“Our investigation at the FBI is ongoing, and there are scores of people in this Discord chatroom. But we have to effectuate the legal process. We have to go out there with search warrants,” he continued, “so that if prosecutors later want to use this evidence, it’s not tainted by being illegally obtained.

Patel promised that, in the coming days, “scores of individuals” and their family members will be interviewed as part of the FBI’s investigation.

The Federal Bureau of Investigation is investigating social media posts by at least seven different accounts that appeared to indicate foreknowledge of the assassination of Charlie Kirk, according to three people familiar with the investigation and screenshots obtained by the Washington Free Beacon.

The posts—one of which referenced the date of Kirk’s assassination, September 10, more than a month before it took place—were all deleted in the days following the killing. Several of the accounts appear to belong to transgender individuals, and at least one of them followed suspect Tyler Robinson’s roommate, with whom Robinson was allegedly in a relationship, on TikTok.

The FBI has received archived copies of the posts, according to a person who flagged them for the agency. Screenshots of the posts have been circulating online but had not been previously authenticated.

While the posts do not establish that any of the individuals knew or conspired with Robinson, the 22-year-old gunman who allegedly shot Kirk, several of them mention the conservative activist by name and fantasize about his death.

Professor ‘kidnapped’ by ICE indicted for assaulting federal officers

The California State University professor whom the California Faculty Association claimed was “kidnapped” by Immigration and Customs Enforcement has officially been indicted by a grand jury for assaulting federal officers.

In July, the CFA had alleged ICE tossed CSU Channel Islands professor Jonathan Caravello into an unmarked vehicle “without identifying themselves” or giving a reason for the arrest.

The night before the incident, Caravello had told the City of Camarillo Council that he was “patrolling the city streets following armed masked thugs trying to kidnap my [undocumented] neighbors.”

Caravello, who teaches math and philosophy and researches epistemology, rationality, and “transcendental arguments,” became involved with a protest against an ICE raid of the Glass House Farms marijuana facility.

Despite complaints by the CFA and the university that Caravello was “peacefully” demonstrating, U.S. Attorney Bill Essayli said the professor was arrested for throwing a tear gas canister at officers.

A Democratic lawmaker in Arizona who is facing calls for expulsion for resharing an Instagram post warning of immigration enforcement activity near an elementary school said that state senate Republicans “absolutely are trying to make an example out of me”.

Analise Ortiz, a Democratic state senator in Arizona, shared an Instagram post from a community organization that warned, in text only, that immigration enforcement agents were near a local elementary school.

“Alert/Alerta: ICE activity near Southwest Elementary,” the post in early August said, adding the cross streets of the school. “ICE is present. La migra esta presente.”

That post is at the center of an ethics complaint filed this week against Ortiz and a viral rightwing campaign against her.

“The ethics complaint very clearly says that they want to stop other people from sharing this type of information,” she said, calling it “a stunning escalation of intimidation”.
